Takings and Land Use Regulation: A Review of Recent Law Journal Literature

No topic in land use regulation has been more important in recent years than the issue of takings: how far can land use regulation go before courts will find it illegal or require government to pay compensation to land owners whose property has been "taken" as a result of overregulation (unlike an actual taking of property through the exercise of the power of eminent domain). This article examines the substantial recent literature of takings, emphasizing the role played by the United States Supreme Court, which has developed a fairly complex view on takings. In addition to Supreme Court matters, the bibliography also reviews state takings issues, questions of policy, and legislative action.
